What are common matters discussed during a divorce?

As the years go by, the divorce rate in the United States continues to increase. Some people may be under the impression that simply filing and signing divorce papers means the end to all of their issues with their spouse, but that is not the case. Due to the various matters needing to be discussed during a divorce, the process is rarely easy for the parties involved.

If you are planning to or have filed for divorce, common issues to be discussed during the process include:

  • Division of property and assets
  • Child custody
  • Child support
  • Alimony and spousal support
  • Debts
  • Bank accounts
  • Motor vehicles

When two people sit down to discuss these divorce matters, the goal is to find a situation or agreement that works best for both parties. In some cases, these matters can be resolved outside of court depending on how cooperative each party is with one another and their attorneys. For example, if the two spouses agree on who will receive what property and/or motor vehicles, there is no need for them to go to court because no one is contesting the divorce or how property and assets will be divided.

It is a similar situation if a prenuptial agreement exists. In this case, specific terms have been laid out prior to the marriage that each party agreed to should they ever divorce. Having a prenup can make the process of divorce easier and help both parties avoid expensive lawyer fees when it comes time for them to go their separate ways.

How the divorce process will go is dependent upon many things, but with most divorces, there is always something to be discussed before it is finalized. If you are going through a divorce, a Texas divorce attorney can assist you with the process.
