Grounds for divorce in Texas

You do need to have grounds for divorce in Texas, which can include one of the following seven:

  • Insupportability
  • Cruel treatment
  • Adultery
  • The spouse receiving a felony conviction
  • Abandonment
  • Living apart for three years or longer
  • Confinement of one spouse to a mental hospital

However, since Texas is still a no-fault state, the grounds of insupportability do not place blame or fault on either party in the separation. It simply means that there are differences or disagreements in the marriage that both spouses are unable to work out.

Proving insupportability

As the most commonly used reason for divorce in Texas, insupportability covers many situations. To obtain a divorce on this basis, you must show that you and your spouse have disagreements that caused the marriage to disintegrate and that there is no feasible chance of ending the conflict. This option is suitable when the other six grounds for divorce in Texas do not apply to a couple.
