3 myths about child custody in Texas

If you are getting ready for a divorce, you may look for all the advice you can get about child custody. This may involve asking friends questions or searching topics online. But this may end up in you receiving a lot of misinformation, no matter how well-meaning the source is. 

Child custody can be one of the most confusing aspects of divorce, even if you have accurate information about the subject. Myths and misconceptions can lead you down the wrong path and hurt your chances of getting the custody order you want. Here are some common misunderstandings about custody and visitation in Texas.

Myth #1: The higher-earning spouse gets custody

You may assume that the spouse who earns the most income deserves the right to see the child more, but this is not always the case. In fact, if there is a stay-at-home parent, the court may be in favor of giving that parent more time with the child. The working spouse may need to pay child support, as well. 

Myth #2: Proving the other parent is bad will help you get custody

Negotiating custody is a tricky process that may involve various tactics. While you certainly want to report any history of abuse, neglect, addiction or criminal behavior, you generally want to stay away from smearing your ex’s name. Constantly badmouthing the other parent may actually look bad in the eyes of the court. Instead, focus on what makes you a good parent. 

Myth #3: A court order is not necessary

Many people believe that getting a court-ordered custody arrangement is not required. If you and your ex get along well and are not big planners, you may think this is a good idea. However, having an order and parenting plan in place helps prevent issues from arising in the future.
