What types of child custody are there in Texas?

During a divorce, deciding on child custody can often be the hardest part. Most of the time, parents want to keep access to their children. However, usually, the judge drafts a plan that splits up time between the petitioner and the divorcee in a fair and safe way. It is important to know the types of child custody in Texas so that you know your options during the proceedings.

The first type of conservatorship (the term used for child custody cases in Texas), is joint managing conservatorship, or JMC. As the phrase suggests, this is when both parents keep some jurisdiction over a child. JMC does not mean that each parent has the same type of control or amount of access. Some rights may even be awarded to one parent only. It is the judge who will decide the responsibilities and limits of each parent.

Sole Managing Conservatorship (SMC) is when only one parent remains the legal guardian of a child. Having SMC gives them certain rights. These rights can include deciding where the child lives, how they receive medical care, and getting child support. A judge might assign SMC for multiple reasons. Examples include if this parent causes any danger to the child. The court may also believe that the parent is unfit to serve as a guardian and caretaker.
