What is fixed visitation?

Child custody disputes can quickly turn nasty, especially if both parents are seeking sole custody of their child. Even though both parents have a preference of what type of child custody they want, the courts don’t always consider the desires of the parents. In fact, it is not uncommon for one parent to have sole custody and the other to only have visitation rights.

When a judge awards one parent visitation, they leave both custodial and non-custodial parents in charge of picking and choosing when the non-custodial parent will get to see their child, with the custodial parent typically having more of a say. This isn’t always the case, as there is another option when it comes to visitation. If the custodial parent isn’t granted the power to come up with a visitation schedule, there is the chance that a parent may be given a fixed visitation schedule. What this means is that the judge tells the parent what time and, sometimes, where they can see their child.

If a parent is placed on a fixed visitation schedule, it may be because the two parents still have an issue that needs to be worked out. It can also be assigned because it gives the child more stability during a hectic time in their lives. Fixed visitation may seem like an unfair decision, but if it allows the children be more stable, parents do not need to look at it as a bad thing.
