Josh Hamilton files divorce petition

Josh Hamilton, a former professional baseball player with the Texas Rangers, filed for divorce from his wife in February. The divorce petition was filed in Tarrant County after the couple had been married for 11 years. ‘Discord or conflict of personalities between Petitioner and Respondent” was listed as the reason in the divorce petition.

According to court documents, Hamilton made several requests in his petition. He asked the court to prohibit his wife from using a vintage 1972 Chevrolet Blazer and a Maserati. Hamilton also petitioned the court to bar his wife from hiding their children, making negative comments about him or inviting a romantic partner to their house while the children were there.

Hamilton and his wife were married in 2004 and have two children together who are now ages 14 and 3. After playing five seasons for the Texas Rangers, Hamilton signed a new contract with the Los Angeles Angels in 2012 that is reportedly worth $125 million over a period of five years. Recently, Hamilton said that he had experienced a relapse of an admitted drug problem.

When a spouse first files a divorce petition, a judge may issue temporary orders concerning child custody and property division issues. These temporary orders may help to establish which spouse will remain in the marital home and where children will reside pending the final divorce settlement. Although they are not permanent, temporary orders may help to set an important precedent for the judge’s final rulings. People who are filing for divorce may want to obtain the advice of legal counsel in order to ensure that their positions on temporary child custody and property division orders are made clear to the court.
